Please read these Terms of Service ("Terms") carefully before using Wylee (the "App"), developed and operated by Circadify LLC ("Circadify", "we", "our", or "us"). By downloading, accessing, or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility & Intended Use
Wylee is designed for both children and adults to help manage anxiety and panic attacks. If you are under 13, you must have a parent or legal guardian read and agree to these Terms on your behalf.
2. Subscription & Billing
- Premium Plan – Wylee offers an optional yearly subscription at USD 34.99 (or local equivalent) for unlimited AI calling and access to all available stories and exercises.
- Auto-Renewal – Subscriptions automatically renew at the end of each period and your payment method on file will be charged unless you cancel at least 24 hours before renewal. Manage or cancel your subscription in your device platform's account settings (e.g., Apple App Store or Google Play).
- Free Tier – You may use Wylee for free with limited features. Free users are still bound by these Terms.
- No Prorated Refunds – Except where required by law, partial or prorated refunds for unused subscription periods are not offered.
3. AI-Generated Content Disclaimer
Wylee uses artificial intelligence (AI) models, which are inherently unpredictable. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content. You acknowledge and accept all risk arising from use of AI content.
4. Not Medical or Mental-Health Advice
The App provides relaxation and anxiety-management tools and does not constitute medical, psychological, or therapeutic advice. Always consult a qualified professional if you have concerns about your mental or physical health.
5. Privacy
Your use of the App is also subject to our Privacy Policy.
6. User Conduct
You agree to use Wylee only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use of the App. Attempts to reverse engineer, exploit, or misuse the App or its freemium features are prohibited.
7. Intellectual Property
All content in Wylee, including but not limited to text, graphics, audio, and code, is the property of Circadify LLC or its licensors and is protected by intellectual-property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
8. Modifications to the Service
We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the App.
9. Security & Data Breaches
While we employ industry-standard security measures, you acknowledge that no system is perfectly secure. We are not responsible for any damages arising from data breaches, unauthorized access, or other security incidents.
10. Limitation of Liability
To the maximum extent permitted by law, Circadify LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or goodwill, arising out of or related to your use of the App, even if we have been advised of the possibility of such damages. Our total cumulative liability shall not exceed the amount you paid to us, if any, within the past twelve months.
11. Indemnification
You agree to defend, indemnify, and hold harmless Circadify LLC, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the App or violation of these Terms.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflicts-of-law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue therein.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated through the App or via email (if provided). Continued use of Wylee after changes constitutes acceptance of the revised Terms.
14. Apple App Store Compliance & Third-Party Beneficiary
You acknowledge that these Terms are concluded solely between you and Circadify LLC, and not with Apple Inc. Wylee is solely responsible for the App and its content. Apple has no obligation to provide maintenance or support services for the App.
Purchases you make through the iOS version of Wylee are processed via Apple's In-App Purchase (IAP) platform. All billing, cancellations, and refund requests are handled by Apple and are subject to Apple's App Store terms, conditions, and refund policies. We do not receive your full payment information; Apple provides us only with a transaction identifier so we can validate your subscription.
Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
